The trigger points for when a new EPC is required, under the MEES legislation, have been amended. Only when a new tenancy commences will an EPC showing a minimum Band Rating of E be required. Tenants who make amendments to their contracts or change to a ‘periodic arrangement’ no longer trigger a requirement to show compliance with the legislation at that time. At present, as long as the same tenant remains in occupation, no trigger point will have been reached’.
With effect from 1st April 2020, however, the legislation requires that, the vast majority of private rental sector properties which currently have an EPC will require an EPC showing a minimum energy efficiency rating of Band E whether or not any changes to the contract or occupants have taken place’.
